The petitioner seeks regular bail in connection with Phulwari Sharif PS case no. 358 of 2019 instituted for the offences punishable under Sections 467, 468, 120(B) of Indian Penal Code and 30(a) of Excise Act.

The allegation is regarding recovery of huge quantity of liquor from a Sumo vehicle and the petitioner was caught while he was sitting in the said vehicle. The learned Senior counsel for the petitioner submits that more or less, similarly situated co-accused persons have already been granted bail by co-ordinate Benches of this Court vide orders dated 18.10.2019 and 23.10.2019 passed in Cr. Misc. no. 62720 of 2019 and 62483 of 2019 respectively. It

Patna High Court CR. MISC. No.68948 of 2019(2) dt.20-11-2019 2/2 is further submitted that the petitioner is having a fair antecedent except one case, in which he is on bail. Lastly, it is submitted that the petitioner is languishing in custody since 30.08.2019. Having regard to the facts and circumstances of the case, the abovenamed petitioner is directed to be released on regular bail on furnishing bail bond of Rs. 10,000/- (Rs. Ten thousand) with two sureties of the like amount each to the satisfaction of learned Special Judge, Excise Act, Patna in connection with Phulwarisharif PS case no. 358 of 2019.
