2. The present petition has been preferred for the grant of following relief(s):

"for issuance of an appropriate Writ, preferably a Writ in the nature of Writ of Mandamus, commanding the respondents to forthwith trace and supply a certified Copy of the Batwara Khatiyan pertaining to (i) Khata No. 26/1, 78/35 & (ii) Khata No. 78/37, 78/38,

Patna High Court CWJC No.17724 of 2025(2) dt.18-11-2025 2/3 26/4 situate within Thana No. 113, Mauja Rasulpura, Block Meskor (Narhat) District - Nawada (Part of Old Gaya district) prepared under section 49 of the Partition Act 1897 and adopted under Section 50 of the said Act for the purpose of partition in the Case No. 25/193738."

3. Learned counsel for the petitioner submits that for procurement of the certified copy of the partition paper relating to the land in question as incorporated above, the petitioner is running from pillar to post (Gaya to Nawada).

4. The contention is that earlier, Nawada was part of Gaya and after becoming the new district, the records as per the respondents is/are not available.

5. In the background of the limited prayer that has been made by the petitioner, this Court deems it fit and proper to dispose of the same with the directions as follow: (i) the petitioner shall be filing a fresh petition before the respondent no.3, the Collector-cum-District Magistrate, Gayaji, within a period of four weeks;

(ii) a copy of the same shall also be

Patna High Court CWJC No.17724 of 2025(2) dt.18-11-2025 3/3 filed before the respondent no.4, the Collectorcum-District Magistrate, Nawada; (iii) the Collector, Gayaji shall be taking up the matter with the Sub-Divisional Officers both at Gayaji and Nawada and after ascertaining the facts as also the document that the petitioner is asking for;

(iv) shall be doing the needful, preferably by 31.03.2026.

6. The writ petition is disposed of with the aforesaid observations.
