JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 04-11-2019 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. Petitioner seeks bail in a case registered for the offences punishable under Section 30(a) Bihar Prohibition and Excise Act 2018.

Petitioner and some others were arrested while they were allegedly engaged in preparing country made liquor. However, the seizure list annexed with the petition goes to show that the alleged recovery was made near Pipal Tree. Submission on behalf of the petitioner is that petitioner does not have any case of Excise Act except the present one and as a matter of fact, he was caught by the police from his house and on the instigation of enemies of the petitioner, he was implicated by the police in the present case.
