IN THE HIGH COURT OF JUDICATURE AT PATNA

Criminal Appeal (SJ) No.912 of 2018 Arising Out of PS.Case No. -23 Year- 2017 Thana -SC/ST District- SHEOHAR ===========================================================

1. Rohit Kumar, S/o Lalbabu Rai @ Surendra Kumar, Resident of Village-Hirauta, P.S.-Tariani, Dist.-Sheohar .... .... Appellant/s

Versus

1. The State of Bihar .... .... Respondent/s =========================================================== Appearance :

For the Appellant/s : Mr. Yashraj Bardhan, Adv For the Respondent/s : Smt. Usha Kumari No.1, SPP =========================================================== CORAM: HONOURABLE MR. JUSTICE BIRENDRA KUMAR ORAL JUDGMENT Date: 15-05-2018 Heard learned counsel for the parties.

This is an appeal under Sections 14(A)(2) of the Scheduled Castes and Scheduled Tribes (Prevention of Atrocities) Act, against refusal of the prayer for anticipatory bail by the learned Additional Sessions Judge-I-cum-Special Judge, Sheohar in connection with Sheohar SC/ST P.S.Case No. 23 of 2017 registered under Sections 341,323,379,384,387,504/34 of the Indian Penal Code as well as under Sections 3(I)(r)(s) of the Scheduled Castes and Scheduled Tribes Act.

Allegation against the appellant is that he intercepted the informant on the way and asked for ransom and on refusal, committed assault, abuse and theft. Learned counsel for the appellant submits that

Patna High Court CR. APP (SJ) No.912 of 2018 dt.15-05-2018 during investigation, some of the witnesses have stated some different story that the informant was himself in the habit of teasing the girls of the locality and for that reason, he was pressurized by the villagers, leading to the lodging of the present false case.

Considering the nature of allegation in the FIR and supporting evidence in the case diary, I do not find anything to interfere with the impugned order, whereby prayer for anticipatory bail has been refused.

Accordingly, this appeal stands dismissed.
