JUSTICE VINOD KUMAR SINHA ORAL ORDER 05-07-2018 Petitioner apprehends his arrest in connection with Mashrak P.S.Case No. 263 of 2017 registered for the offences punishable under Sections 302, 120B and 34 of the Indian Penal Code.
Petitioner is not named in the FIR and there was illicit relationship between one Sonu and Mala Kumari (deceased). Allegation against Sonu and other accused persons is of taking the deceased, keeping her in a room and later on her dead body was found. It appears that name of petitioner has come during investigation in confessional statement of co-accused. Submission of learned counsel for the petitioner is that except confessional statement of co-accused there is nothing against the petitioner. Further submission is that Sonu has been
Patna High Court Cr.Misc. No.17774 of 2018 (3) dt.05-07-2018 2/2 granted bail vide order dated 26.4.2018 in Cr.Misc.No.16626 of 2018.
Heard learned APP and learned counsel for the informant, who has opposed the prayer for anticipatory bail on the ground that petitioner has active role in the crime and as such he does not deserve bail.
Having heard both sides and in the facts and circumstances, I am not inclined to grant privilege of anticipatory bail to the petitioner.
This application is dismissed.
