This is an application for regular bail in connection with Kanti P. S. Case No. 424 of 2017 registered for the offences punishable under Sections 413 and 414 of the Indian Penal Code.

Allegation, according to informant, is that on receiving information that three miscreants were going to Motipur Bazar for selling the stolen motorcycle, he along with police personnel checked the motorcycles and arrested the miscreants along with the motorcycle. On enquiry, they failed to produce necessary papers of the motorcycle. It is submitted on behalf of the petitioners that they

Patna High Court Cr.Misc. No.60006 of 2017(3) dt.12-01-2018 2/2 are innocent and have been implicated in this case only on the basis of suspicion. Neither any incriminating articles were recovered from their possession nor they were arrested on the spot. Petitioners are in jail custody since 16.10.2017. It is further submitted that one similarly situated co-accused, namely, Deepak Kumar, has been enlarged on bail by a Bench of this Court in Cr. Misc. no. 1156 of 2018.

Considering the facts and circumstances of the case, let above named petitioners be enlarged on bail on furnishing bail bond of Rs.10,000/- (Ten thousand only) each with two sureties of the like amount each to the satisfaction of learned Sub-Divisional Judicial Magistrate, West Muzaffarpur, in connection with Kanti P.
