Petitioner seeks bail in a case registered for the offence punishable under Section 30(a) of the Bihar Excise and Prohibition Act.

Petitioner is in jail custody since 22.08.2019 and according to prosecution case itself, he was caught on the spot and in course of investigation, witnesses claimed that petitioner was driver of the pick up vehicle but the first information report goes to show that seized liquor belongs to F.I.R. named accused Hanuman Singh and even if, it assumed to be true that the petitioner was driver of the pick up vehicle from which, the country made liquor was recovered, then also, the petitioner had
