1. Heard learned counsel for the petitioner and learned counsel for the respondents.

2. The petitioner has filed the instant application for a direction to the respondents specially the District Magistrate, Saran (respondent no.3) to pay to the petitioner the arrears of salary for the period from 1.6.2007 to 31.3.2017 along with interest thereon.

3. It is the case of the petitioner that though he retired while working on the post of Panchayat Secretary on 31.1.2017 from the office of the Block Development Officer, Sonepur, Saran, he was not paid his dues including his arrears of

It was only vide order contained in memo no.1372 Saran dated 15.9.2023 (Annexure-P/6) issued under the signature of the Block Development Officer, Sonepur, Saran that the petitioner was given certificate to the effect that after enquiry the authorities have arrived at a conclusion that no amount was due from the petitioner.

4. Learned counsel for the petitioner submits that the arrears of salary for the period 1.6.2007 to 31.3.2017 still remains unpaid. As such it is prayed that the instant writ application be disposed of enabling the petitioner file a representation before the respondent no.3 with a direction to the District Magistrate concerned to pay the arrears of salary found admissible to the petitioner within reasonable period.

Having heard learned counsel for the petitioner and having perused the contents of the petition, the writ application is disposed of directing the petitioner to file a representation before the respondent no.3 within a period of four weeks. In case such a representation is filed, the respondent no.3 shall decide the same within a period of three months from the date of its filing and in case any amount found payable, the same shall be paid to the petitioner within a period of two months from the date of passing of the order.

6. In case any amount is not found payable/admissible, a reasoned order for the same shall be communicated to the petitioner within the aforesaid period.

7. It is made clear that the Court has not gone into the merits of the case of the petitioner which is to be decided by the respondent concerned.

8. The writ application stands disposed of with the above observations and directions.
