The petitioner apprehends his arrest in connection with Fathehpur P.S. Case No. 68 of 2019 registered for the offences punishable under Sections 341, 323, 307/34 and 302 of the Indian Penal Code.

On 12.03.2019, in course of plying the tempo, the coaccused boarded on the tempo of Jamshed Kha and when both got down from the tempo t hen Jamshed Kha, son of the informant, demand fare on which both caused assault to him through fists and slaps. Thereafter, Jamshed Kha claimed abdominal pain and he was rushed for treatment, but he died in course of treatment on next day.

Learned counsel for the petitioner submits that the

Patna High Court CR. MISC. No.65934 of 2019(3) dt.04-03-2020 2/2 petitioner is not named in the F.I.R. Learned counsel for the petitioner further submits that the petitioner has been made accused on the basis of statement of one witness Surendra Chaudhary.

Learned counsel for the informant has opposed the prayer for grant of anticipatory bail.

Learned counsel for the petitioner further submits that similarly situated co-accused has been granted anticipatory bail by this Co-ordinate Bench of this Court vide order dated 18.11.2019 passed in Cr. Misc. No.68200 of 2019. In the facts and circumstances of the case, let the above named petitioner be released on bail, in the event of arrest or surrender before the learned Court below within a period of six weeks from today, on furnishing bail bond of Rs. 20,000/- (twenty thousand) with two sureties of the like amount each to the satisfaction of A.C.J.M.-Xth, Gaya in connection with Fathehpur P.S. Case No. 68 of 2019, subject to the condition as laid down under Section 438(2) of the Cr.P.C. (Anjani Kumar Sharan, J) Nasimul/- U T
