JUSTICE VINOD KUMAR SINHA ORAL ORDER 21-10-2019 This is an application for grant of anticipatory bail in connection with Ramgarh P. s. Case No. 202 of 2019, disclosing offences under Sections 153 (A) (2), 295, 295(A) and 34 of IPC. As per F.I.R. petitioners and some other miscreants are said to be damaging the temple in the village and petitioners were named by the Chowkidar of the village.

Submission of the learned counsel for the petitioners is that they have falsely been implicated in this case, at the instance of the Chowkidar, from which, they have enmity with them. They are ready to abide by any conditions imposed upon them.

Let the petitioners, above named, in the event of their arrest or surrender before the court below within six weeks, be released on bail on furnishing bail bond of Rs.25,000/- (Rupees Twenty Five Thousand) each with two sureties of the like amount to the satisfaction of learned Additional Chief Judicial Magistrate, 1st Class, Kaimur at Bhabhua, in connection with Ramgarh P. s. Case No. 202 of 2019, subject to the condition laid down under Section 438(2) of the Code of Criminal Procedure with condition that they will not threaten the informant or tamper with the evidence.
