2. The present application is for grant of anticipatory bail, in connection with Naugachia P.S. Case No.123 of 2024 for offences under Sections 498A, 323, 379 and 34 of the Indian Penal Code.
3. From the perusal of the First Information Report, it would appear that the petitioners along with other co-accused persons instigated the husband of the informant to inflict cruelty upon her. The present petitioners are the father-in-law and motherin-law of the informant/victim.
4. Learned counsel for the petitioners submits that the petitioners are living separately from the husband of the informant and have no concern with the family affairs of the informant.
Patna High Court CR. MISC. No.79360 of 2024(4) dt.11-04-2025 2/2 Moreover, the allegations are general and omnibus in nature and are specific to some extent against the husband of the informant, who is primarily responsible for the welfare of his wife.
5. Learned APP for the State opposes the prayer for anticipatory bail application.
6. Considering that the petitioners, above named are the father-in-law and mother-in-law of the informant and also considering the fact that both are old aged persons, let the petitioners, in the event of their arrest or surrender before the Court below within four weeks, be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, 1st Naugachia, in connection with Naugachia P.S. Case No.123 of 2024, subject to the condition laid down under Section 438 (2) of the Code of Criminal Procedure/Section 482 (2) of the B.N.S.S., 2023 and subject to the further condition that the petitioner shall co-operate in the investigation/trial.
