Case No. 50 of 2019, registered for the offences punishable under Sections 304 and 201 of the Indian Penal Code. Petitioner is said to have assaulted by means of Farsa to the deceased, causing his death.

Submission of learned counsel for the petitioner is that occurrence took place with respect to digging of land and at the spur of moment he assaulted the deceased and he has no intention to kill him and he is in custody for eight months and charge has already been framed in this case.

Heard learned APP and perused the report of learned trial court from which it appears that two witnesses have been examined and they have been declared hostile. In view of above facts and circumstances, let

Patna High Court CR. MISC. No.65356 of 2019(4) dt.31-01-2020 2/2 petitioner be released on bail on furnishing bail bond of Rs.25,000/- (Rupees twenty five thousand) with two sureties of the like amount each to the satisfaction of the S.D.J.M., Daudnagar (Aurangabad), in connection with Haspura P.S. Case No. 50 of 2019 subject to the condition that he has to appear on each and every date before the trial court except showing genuine reason, otherwise his bail bonds shall be cancelled.
