JUSTICE RAJIV ROY ORAL ORDER 29-02-2024 Heard Mr. Jitendra Narain Sinha, learned counsel appearing on behalf of the petitioner and Mr. Madhav Kumar, learned counsel appearing on behalf of the informant as also the State.
2. The petitioner is apprehending his arrest in connection with Singhia P.S. Case No. 72 of 2023 for the offence under Sections 341, 323, 325, 307, 504, 379 and 34 of the I.P.C. lodged on 15.04.2023, by the informant, Vijay Kumar.
3. As per the prosecution story, the allegation in the FIR is that when the informant alongwith his brother and children went to his plot to pick up wheat crop, the accused persons surrounded the informant and after abusing opened fire in the air. Further, the allegation against this petitioner is of
Patna High Court CR. MISC. No.75114 of 2023(3) dt.29-02-2024 2/2 using iron rod, causing injury on hand and stomach. As per the injury report which is part of the case diary, there is fracture on the left hand.
4. Learned counsel for the petitioner submits that he is a young boy, has no criminal antecedent and that be considered for grant of anticipatory bail.
5. Learned counsel appearing on behalf of the informant submits that the injury report shows that there is fracture in the hand.
6. In that background, it would be appropriate that the petitioner seeks bail.
