====================================================== CORAM: HONOURABLE MR. JUSTICE PURNENDU SINGH ORAL ORDER 24-01-2025 Heard Mr. Dhananjay Kumar Tiwary, learned counsel appearing on behalf of the petitioner and Dr. Kumar Uday Pratap, learned APP for the State.
2. The petitioner seeks modification of the order dated 10.07.2024 passed in Cr. Misc. No. 40459 of 2024.
3. Learned counsel appearing on behalf of the petitioner submits that the petitioner was directed to be released on pre-arrest bail vide order dated 10.07.2024 passed in Cr. Misc. No. 40459 of 2024 subject to verification of the injury report. However at the time of verification of the injury report, bail bond was not accepted considering the fact that there were certain overwriting on the injury report.
4. The petitioner in Para-4 of the modification
Patna High Court CR. MISC. No.78355 of 2024(3) dt.24-01-2025 2/2 application has given information that the overwriting on the injury report is not a manipulation rather the same has been done by the doctor concerned who has found the injury to be simple in nature.
5. In view of the information given in the modification application, further period to surrender before the learned District Court is extended till 06.02.2025. The learned District Court is directed to accept the bail bond of the petitioner.
6. The modification application stands disposed of. The other part of the order dated 10.07.2024 shall remain intact. (Purnendu Singh, J) mantreshwar/- U
