2. The petitioner has prayed for regular bail in a case registered for the offence punishable under sections 341, 323, 324, 506/34 of the Indian Penal Code and later on added section 307 of the IPC.
3. As per prosecution case, the petitioner is alleged to have assaulted the informant as well as his husband by means of knife due to which both of them sustained injury.
4. Learned counsel for the petitioner submits that the petitioner is innocent and has committed no offence. The informant is own sister-in-law (bhabhi) of the petitioner and a land dispute is going on them due to which this petitioner has been implicated in this false case. There is delay of three days of
Patna High Court CR. MISC. No.75851 of 2023(2) dt.30-11-2023 2/2 lodging the FIR. It is further submitted that the petitioner is languishing in judicial custody since 2.6.2023.
5. Learned APP appearing for the state has opposed the prayer of regular bail.
6. Having heard learned counsel for the parties and considering the facts and circumstances of the case as well as custody of the petitioner, this court is inclined to enlarge the petitioner on bail. The above named petitioner is directed to be released on bail in connection with Dariyapur P.S. Case No. 282 of 2023 on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Additional Sessions Judge 5th, Saran at Chhapra DistSaran.
