The petitioner apprehends his arrest in connection with Kishanganj P.S. Case No.496 of 2017 registered under Sections 387, 504 and 506/34 of the Indian Penal Code. The accusation is that Ashraf Ali alias Guddu, the brother of the informant Md. Musharraf Ansari, contested the election against the mother of the petitioner in which the brother of the informant was defeated. Thereafter, the petitioner alongwith antisocial elements came at the house of the informant and started to abuse saying that due to contest in the election by his brother, he had suffered loss of Rs.10-12 lacs and gave threatening that if the same is not paid, he and his family members would be shot

Learned counsel for the petitioner submits that, in fact, while the brother of the informant contested the election against the mother of the petitioner but the brother of the informant was defeated and the mother of the petitioner elected in the election, due to that reason, only to put undue pressure, the informant has lodged this false case.
Having considered the facts and the circumstances of the case, let the petitioner, above named, in the event of his arrest or surrender by him within six weeks from today, be enlarged on bail on his furnishing bail bond of Rs.10,000/-(Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the Chief Judicial Magistrate, Kishanganj, in connection with Kishanganj P.S. Case No.496 of 2017, subject to the conditions laid down under Section 438(2) Cr.P.C.
