JUSTICE SANDEEP KUMAR ORAL ORDER 04-03-2023 Heard learned counsel for the petitioner and learned Additional Public Prosecutor for the State. The petitioner is in custody since 06.11.2022 in connection with Hajipur Excise P.S. Case No. 314 of 2022 registered for the offence punishable under Sections 30(a), 32(i) (3), 41(1),(2) of the Bihar Prohibition and Excise Amendment Act, 2018.

Recovery is of total 200 litres of Chulai wine. Considering the nature of allegation levelled against the petitioner and also the fact that he is in custody since 06.11.2022, this application for regular bail is allowed. In view of the aforementioned facts and circumstances, let the petitioner above named be released on

Patna High Court CR. MISC. No.73833 of 2022(2) dt.04-03-2023 2/2 bail after framing of charge if the charge in not framed yet or on furnishing bail bonds of Rs.10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Learned Special Excise Court No.2 cum A.D.J. Vaishali at Hajipur in connection with Hajipur Excise P.S. Case No. 314 of 2022.

The petitioner would cooperate in the proceeding of the Court below. If the petitioner tries to delay the trial, the Court below is at liberty to pass an appropriate order including the cancellation of bail bonds of the petitioner. The petitioner is directed to appear before the Court below through his lawyer or himself on each date, failing which, his bail bonds shall be cancelled.
