Earlier prayer for bail of the petitioner was twice rejected by this court but again, bail is sought on the ground that having similar allegation co-accused Uday Kumar and Santu Kumar have already been granted privilege of bail by a coordinate bench of this court as well as this bench vide Cr. Misc. no. 34730/2016 and Cr. Misc. no. 11824/2017 respectively.

Taking into consideration the above stated submissions and also keeping in mind that case of the petitioner stands on similar footing to above stated co-accused, let the petitioner be released on bail on furnishing bail bonds of Rs 10,000/- with two sureties of the like amount each to the satisfaction of the Addl. Sessions Judge IX, Patna in Sessions trial no. 791/2016 arising out of A.T.S. (Bihar) P.S. Case no. 01/2016 subject to condition that one of the sureties must be
