2. The petitioner has prayed for regular bail in a case registered for the offence punishable under section 414 of the Indian Penal Code.

3. As per prosecution case, some culprits were arrested with stolen motorcycle who disclosed the name of the petitioner. Thereafter, search has been made and a motorcycle bearing Registration no. BR21A-7103 from door of the petitioner.

4. Learned counsel for the petitioner submits that the petitioner is innocent and has committed no offence. He has falsely been implicated in this case. His name was disclosed by co-accused persons who were arrested on spot. Nothing has

It is further submitted that the petitioner is languishing in judicial custody since 18.7.2023. Moreover, similarly situated coaccused namely, Vikash Kumar has already been granted bail by a co-ordinate Bench of this Court vide order dt. 23.11.2023 passed in Cr. Misc. No. 73789 of 2023.

5. Learned APP appearing for the state has opposed the prayer of regular bail.

6. Having heard learned counsel for the parties and considering the facts and circumstances of the case as well as custody of the petitioner, this court is inclined to enlarge the petitioner on bail. The above named petitioner is directed to be released on bail in connection with Jamui P.S. Case No. 450 of 2023 on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned C.J.M., Jamui.
