The petitioner is apprehending his arrest in connection with Ramgarhwa P.S. Case No. 17 of 2018 registered for offences punishable under Sections 413, 414/34 of the Indian Penal Code. Allegation against the petitioner is that he has sold the stolen motorcycle to other accused persons.

It has been submitted on behalf of the petitioner that petitioner has been falsely implicated in this case. Nothing has been recovered from his possession. Only on the basis of confession, he has been made accused in the present case. Learned APP has opposed the prayer for bail and submitted that petitioner is accused in one more case that is of the

Patna High Court Cr.Misc. No.25260 of 2018 (3) dt.18-05-2018 2/2 year 2015.

Having heard both sides, considering the criminal antecedent of the petitioner, I am not inclined to grant privilege of anticipatory bail to the petitioner and it is, accordingly, rejected. However, considering the facts and circumstances as detailed in the present application, let the petitioner surrender in the court below and the court below shall consider the case of the petitioner on its own merit without being prejudiced by this order.
