JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 25-10-2019 Heard learned counsel appearing for the petitioner as well as learned Additional Public Prosecutor for the State. Petitioner seeks bail in a case registered for the offences punishable under Sections 25(1-b)A/26/35 of the Arms Act.

According to the prosecution case itself, FIR named accused Ravi Singh, Golu Singh and Vikram Singh opened fire causing death of the deceased and injury to the informant and others. So far as petitioner is concerned, it is only stated that he was also a member of unlawful assembly. Learned counsel appearing for the petitioner submits that prior to registration of first information report of

No.65422 of 2019(2) dt.25-10-2019 2/2 the present case, the petitioner had not been made accused in any other case but after registration of this case, the petitioner has been made accused in three cases and, moreover, one coaccused Gopi Raman @ Gopi Raman Yadav has already been granted privilege of bail by a co-ordinate Bench of this Court. Considering the aforesaid facts and circumstances as well as submissions of the parties and also keeping in mind that the petitioner is in jail custody since 13.6.2019 and the investigation against him has already been completed, let the petitioner, above named, be released on bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of learned S.D.J.M., Darbhanga in connection with Bahadurpur P.S. Case No. 173/2019.
