JUSTICE VINOD KUMAR SINHA ORAL ORDER 08-11-2019 Petitioners seek bail in anticipation of their arrest in connection with Araria (Madanpur O.P.) P.S. Case No. 472 of 2013 registered for the offences punishable under Sections 341, 323, 379 and 504/34 of the Indian Penal Code. So far these petitioners are concerned, there is no specific allegation and there is general allegation that they entered inside the house of informant and snatched chain of the daughter of informant.

No.71461 of 2019(2) dt.08-11-2019 2/2 Submission of learned counsel for the petitioners is that in this case cognizance was taken only under Section 379 IPC and there is family dispute between the parties and petitioner Nos. 1 and 2 are brothers of informant and allegation of snatching chain is ornamental in nature.

In view of above facts and circumstances, let petitioners, in the event of arrest or surrender, be released on bail on furnishing bail bonds of Rs.25,000/- (Rupees twenty five thousand) each with two sureties of the like amount each to the satisfaction of the Judicial Magistrate, 1st Class, Araria, in connection with Araria (Madanpur O.P.) P.S. Case No. 472 of 2013, subject to the conditions as laid down under Section 438(2) of the Cr.P.C. and further condition is that one of the bailors of the petitioners shall be a local person having sufficient immoveable property within the jurisdiction of the court concerned.
