Petitioners apprehend their arrest in connection with Khaira (Nagra) P.S. Case No. 271 of 2017 registered for the offences punishable under Sections 363, 366A, 365 and 34 of the Indian Penal Code.

Allegation against the petitioners is of kidnapping of minor girl of the informant.

Submission of learned counsel for the petitioners is that only on the basis of suspicion they have been made accused in this case and there is no circumstance against them in the case diary. Heard learned APP also.

Having heard both sides and in the facts and circumstances, this application is disposed of with a direction to

Patna High Court Cr.Misc. No.18122 of 2018 (3) dt.25-04-2018 2/2 the petitioners to surrender within a period of four weeks from the receipt of this order and on their so surrendering they shall be released on provisional bail till submission of charge sheet on the condition that they have to co-operate in investigation, otherwise their bail bonds shall be cancelled and further condition is that once charge sheet has been submitted and case is found true against the petitioners, they shall have to surrender and make prayer for regular bail, which shall be considered on its own merit and on the basis of materials available on record, without being prejudiced by this order.
