2. The petitioner apprehends arrest in a case registered for the offence punishable under sections 147, 148, 149, 323, 326, 307, 504, 379, 427 of the Indian Penal Code and section 27 of the Arms Act.
3. As per the prosecution case, all the FIR named accused persons including this petitioner attacked on the house of the informant, made firing and took out gold, cloth, ornaments and cash Rs. 47,000/- from the house and they damaged six motorcycles, a car and constructed roof.
4. Learned counsel appearing for the petitioner submits that the petitioner is innocent and has falsely been implicated in this case. As a matter of fact, under construction building of uncle of informant fell down which is also reflected from the FIR in which vehicles were damaged. Parties are
Patna High Court CR. MISC. No.79649 of 2024(2) dt.27-03-2025 2/2 agnate and due to land dispute, this case has been lodged implicating whole family members with false and concocted allegations. Co-accused, with similar allegation, has already been allowed pre-arrest bail by a co-ordinate bench of this Court vide order passed in Cr.Mis.No. 19345/2024.
5. Considering the aforesaid facts of the case, prayer for bail of the petitioner is allowed. In the event of arrest/surrender within eight weeks from today, let the petitioner, mentioned above, be enlarged on bail on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the court concerned in Begusarai in Birpur Police Station Case No. 202/2023, subject to the conditions laid down under section 438(2) of the Code of Criminal Procedure.
