12-01-2018 Heard learned counsel for the petitioner and the learned A.P.P. for the State.

Petitioner, in the present case, is seeking regular bail in connection with Noorsarai P.S. Case No. 171 of 2017 registered for the offence punishable under Sections 304(B) and 201/34 of the Indian Penal Code and 3⁄4 of the Dowry Prohibition Act.

It is submitted that the petitioner is the grand father-in-law of the deceased and he has been implicated in this case only because he had allegedly participated in the resolution of dispute between the husband and wife and had been accompanying his grand son at the time of Vidai on 04.07.2017. Learned counsel submits that the petitioner is an old man and had always desired the well being of grand

Patna High Court Cr.Misc. No.218 of 2018 (2) dt.12-01-2018 daughter-in-law. It is submitted that the grand son of the petitioner who happens to be the husband has already surrendered and is in custody, however it is not stated in the application, petitioner has no criminal antecedent. Considering the facts and circumstances of the case and materials on record, let the petitioner, above named, be enlarged on bail on furnishing bail bond of Rs. 15,000/- (Rupees fifteen thousand only) with two sureties of the like amount each to the satisfaction of the learned SubDivisional Judicial Magistrate, Nalanda, in connection with Noorsarai P.S. Case No. 171 of 2017, subject to condition as laid down under Section 437(3) of the Code of Criminal Procedure and after verification of fact as to whether or not the husband of the deceased has surrendered.
