JUSTICE ARUN KUMAR ORAL ORDER 15-03-2018 Heard learned Counsel for the petitioner and the State. Petitioner, already in custody, seeks bail in Amas PS Case No. 28 of 2017 registered under Sections 18, 20 and 22 of the NDPS Act.
The allegation in brief is that the police found cultivation of opium in six bighas of land including the land of the petitioner. Learned Counsel for the petitioner submits that there was no cultivation of opium on the land of the petitioner and there is no FSL report that the seized material was opium.
Whereas learned Counsel for the State submits that opium was found planted in the field of the petitioner also and the FSL report of Kolkata indicates that the seized plant was identified as opium poppy pods.
Having considered the said facts and circumstances, presently the prayer for bail of the petitioner is rejected. The trial court is directed to expedite the trial and preferably conclude the same within a period of one year after framing of the charge.
