2. The petitioners have prayed for regular bail in connection with Dighwara P.S. Case No. 253 of 2025 registered for the offence punishable under Sections 191(2), 191(3), 190, 223, 126(2), 115(2), 118(1), 117(2), 118(2), 109, 125(a), 125(b), 324(4), 352, 351(2) and 61(2) of the B.N.S., 2023.

3. The case of the prosecution, in short, is that earlier there was some scuffle between children of two communities and, for that, the family of the children started scuffling. It is alleged that both parties have sustained injuries.

4. Learned counsel for the petitioners has submitted that in this case altogether 19 persons are named and 20-25 persons are unnamed. The petitioners were only the members of the mob. There is no specific or direct allegation of any overt act against the petitioners rather the same is general and omnibus in nature. It is further submitted that the injuries sustained by the injured is simple in nature and only one injury of Saksham Kumar is found to grievous in nature. The petitioners are in custody since 02.07.2025 and bears no criminal antecedent. Learned counsel for the petitioners further submits that the co-accused persons have already been granted bail by different Co-ordinate Benches of this Court vide orders dated 17.09.2025, 24.09.2025 and 07.10.2025 passed in Cr. Misc. Nos. 67489 of 2025, 68010 of 2025 and 68648 of 2025 respectively.

5. Learned Additional Public Prosecutor for the State has vehemently opposed the prayer of bail to the petitioners.

Having heard learned counsel for the parties and considering the entire facts and circumstances of the case, the period of custody of the petitioners, the petitioners having no criminal antecedent as also the prayer for bail being based on parity, this court is inclined to enlarge the petitioners on bail.
