JUSTICE SUNIL KUMAR PANWAR ORAL ORDER 15-01-2024 Heard learned counsel for the petitioner and learned A.P.P appearing on behalf of the State. The petitioner is languishing in custody in a case registered for the offences punishable under Sections 25(1-B) a, 26(ii), 35 of the Arms Act. There is recovery of four country made pistols, seven magazines and two live cartridges from the house of the petitioner.

The petitioner has no concern with the seized arms. The petitioner is languishing in custody since 10.03.2023. A statement has been made in para 3 of the petition that petitioner is accused in three other cases apart from the present one.
In contra, learned A.P.P appearing on behalf of the State has vehemently opposed the prayer for bail of the petitioner and submitted that petitioner is involved in three other cases of similar nature and on his identification, the seized arms were recovered. Considering the facts aforesaid and the fact that petitioner has criminal antecedents of similar nature and on his identification, the arms were recovered, this Court is not inclined to grant the privilege of bail to the petitioner.
The prayer for bail of the petitioner stands rejected.
