This is an appeal under Section 14(A) (2) of the Scheduled Castes and Scheduled Tribes (Prevention of Atrocities) Act, 1989 (hereinafter referred to as the "SC/ST Act") against the refusal of prayer for anticipatory bail vide order dated 24.02.2018 passed by the learned 10th Additional Sessions Judgecum-Special Judge, S.C./S.T. Act, Muzaffarpur in A.B.P. No.394 of 2018, arising out of Aurai Police Station Case No.163 of 2016 registered under Sections 147, 149, 307, 323, 341, 342, 354(B), 504, 506 of the Indian Penal Code and Section 3 (1) (X) (XI) of the Scheduled Castes and Scheduled Tribes (Prevention of Atrocities) Act.
Patna High Court CR. APP (SJ) No.1518 of 2018 dt.14-08-2018 2/2 There is allegation that the appellants tied with rope to Nagendra Ram and Rakesh Kumar and assault was committed. Both have supported the aforesaid allegation before the Police. In my view, prima facie offences are disclosed against the appellants. Hence, I am not inclined to interfere with the impugned order, whereby the prayer for anticipatory bail of the appellants, above named, has been refused Accordingly, this appeal stands dismissed as devoid of any merit.
