JUSTICE SANJAY PRIYA ORAL ORDER 19-06-2018 Heard learned counsel for the petitioner and the State. The petitioner apprehends his arrest in Dandkhora P.S. Case No. 117 of 2017 instituted for the offence under Sections 304(B), 201 and 120(B) of the Indian Penal Code. Petitioner is husband of the deceased. It is alleged in the written report that daughter of the informant has performed love marriage with the petitioner. She was subjected to cruelty and torture by the petitioner on account of non-fulfillment of demand of dowry. It is further alleged that the informant has executed sale deed with respect to 0.61 decimal of land in favour of his daughter under the pressure of the petitioner so that petitioner may maintain his daughter properly in her sasural. It is alleged that in spite of execution of aforesaid sale deed, the petitioner committed physical
Patna High Court Cr.Misc. No.26793 of 2018 (3) dt.19-06-2018 2/2 and mental torture with the daughter of the informant for demand of dowry and finally she died during pregnancy on account of not taking proper care and treatment in her Sasural. The witnesses in the case diary have stated that the daughter of the informant was tortured in her sasural for nonfulfillment of demand of dowry. The petitioner is husband of the deceased.
In such circumstances, this Court is not inclined to grant anticipatory bail to the petitioner.
Prayer for anticipatory bail of petitioner stands rejected.
Petitioner may surrender before the court below and make prayer for regular bail.
