The petitioner seeks pre-arrest bail in connection with Maheshkunt P.S. Case No. 9 of 2019 (G.R. No. 219 of 2019), registered under Section 364A of the Indian Penal Code. Submission is that it would appear from the first information report that petitioner is not named in the first information report as on the basis of the fardbeyan of the informant, Vibha Kumari, Maheshkunt P.S. Case No. 9 of 2019 (G.R. No. 219 of 2019) was instituted on 23.01.2019 under Section 364A of the Indian Penal Code against Balram Chaurasia and some unknown. In course of investigation, victim was recovered with Balram Chaurasia and Balram Chaurasia disclosed the name of his associates, including the name of Princce Kumar, and on that very basis the petitioner has

No.65944 of 2019(3) dt.11-12-2019 2/2 been implicated in this case while there are three persons of name of Prince in the village, one is Prince Kumar and the other is Prince Yadav. The petitioner has no criminal antecedent. Having regard to the facts and circumstances of the case, let the petitioner, above named, in the event of surrender/arrest, within a period of four weeks from today, in connection with Maheshkunt P.S. Case No. 9 of 2019 (G.R. No. 219 of 2019) shall be released on bail on furnishing bail bond of Rs.10,000/- (rupees ten thousand) with two sureties of the like amount each to the satisfaction of Smt. Ankita Jaiswal, Judicial Magistrate, 1st Class, Khagaria, or the successor Court subject to the conditions as laid down under Section 438(2) Criminal Procedure Code.
