JUSTICE CHAKRADHARI SHARAN SINGH ORAL ORDER 18-03-2021 The petitioner claims to be the widow of one Rabindra Nath Singh, who died in harness as Tax Daroga in the office of the Nagar Panchayat, Bhojpur.

This writ application has been filed seeking direction to the Nagar Panchayat, Bhojpur to pay to her the post retiral and other dues, consequent upon the death of the petitioner's husband.

A supplementary counter affidavit has been filed on

Patna High Court CWJC No.21951 of 2019(10) dt.18-03-2021 2/2 behalf of the Nagar Parishad, Bhojpur (respondent no. 2) stating therein that the death-cum-retiral benefits of the deceased employee have already been paid to the elder son of the petitioner. The details of such payments have been given in paragraphs 5 and 6 of the supplementary counter affidavit. There is no representation on behalf of the petitioner. Considering the averments made in the supplementary counter affidavit filed on behalf of the respondent no. 2, as noted above, this application stands disposed of with a liberty to the petitioner to approach the Nagar Panchayat, Bhojpur, in case, according to her, the amount legally admissible to her, has yet not been paid.
