JUSTICE SANJAY PRIYA ORAL ORDER 27-04-2018 Heard learned counsel for the petitioner and the State. The petitioner apprehends his arrest in Chakand P.S. Case No. 161 of 2017 instituted for the offence under Sections 376, 354(D), 509 of the Indian Penal Code, Section 67(A) Information Technology (IT) Act, 2000 and Section 12 of POCSO Act.

It is alleged in the written report that co-accused Sanjeev Paswan had sexually exploited the informant for last 6-7 months and made naked photo of the informant viral on the Whatsap. Rahul Paswan (petitioner) was also involved in the aforesaid occurrence.

Case diary has been received.

The victim girl has given her statement under Section

Patna High Court Cr.Misc. No.17811 of 2018 (4) dt.27-04-2018 2/2 164 Cr. P.C. which is available in paragraph-27 of the case diary wherein she has stated that petitioner has prepared video of the entire affair and had sent the same on Whatsapp to his friends. The other witnesses have also stated that this petitioner prepared video of the affair and made the same viral.

Therefore, this Court is not inclined to grant anticipatory bail to the petitioner.

Prayer for anticipatory bail of the petitioner stands rejected.

Petitioner may surrender before the court below and make prayer for regular bail.
