JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 04-11-2019 Heard learned counsel for the petitioners as well as learned Additional Public Prosecutor for the State. Petitioners seek bail in a case registered for the offences punishable under Sections 153, 153(A), 295, 295(A), 298, 505(2)(3), 504 of the Indian Penal Code and Section 66(A) of I. T. Act.

Petitioners and other F.I.R. named accused are said to have uttered some unparliamentary words with an object to create tension between two communities. Moreover, co-accused Mithilesh Kumar, having more or less similar allegation, has already been granted privilege of bail by a co-ordinate bench of

Patna High Court CR. MISC. No.67098 of 2019(2) dt.04-11-2019 2/2 this court whereas petitioners are languishing in jail custody since 28.06.2019 without having any criminal antecedent. Accordingly, petitioners, above named, are directed to be released on bail on furnishing bail bonds of Rs. 10,000/- (Ten Thousand) each with two sureties of the like amount each to the satisfaction of learned Additional Chief Judicial Magistrate-VI, Saran at Chapra in connection with Nayagaon P. S. Case No. 87 of 2019.
