JUSTICE VINOD KUMAR SINHA ORAL ORDER 07-11-2019 This application, for grant of anticipatory bail, arises out of Motihari Town P.S. Case No. 163 of 2019, disclosing offences under Sections467, 468, 471, 420, 506/34 of the Indian Penal Code.
Petitioner said to be identifier of sale deed, which is alleged to have been executed by impersonating the informant. Submission of learned counsel for the petitioner is that prior to lodging of the present F.I.R. an F.I.R. has been lodged by the petitioner's side against the informant that in spite of taking money, he was not executing the sale deed and considering the same co-accused of this case have been granted privilege of anticipatory bail by this Court vide order dated 26.09.2019 passed in Cr. Misc. No. 61504 of 2019 as well as by
Patna High Court CR. MISC. No.71051 of 2019(2) dt.07-11-2019 2/2 coordinate Bench of this Court vide order dated 17.09.2019 passed in Cr. Misc. No. 58683 of 2019.

Having heard both sides, in view of the above facts, this application is allowed. Let the petitioner, above named, in the event of his arrest or surrender before the court below within six weeks, be released on bail on furnishing bail bond of Rs. 25,000/- (Rupees Twenty five Thousand) each with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, East Champaran, Motihari, in connection with Motihari Town P.S. Case No. 163 of 2019, subject to the condition laid down under Section 438 (2) of the Code of Criminal Procedure.
