====================================================== CORAM: HONOURABLE MR. JUSTICE PRABHAT KUMAR SINGH ORAL ORDER 03-07-2024 Heard learned counsel for the petitioners and the State.

2. Petitioners apprehend arrest in a case registered for the offence punishable under sections 365, 364/34 of the Indian Penal Code.

3. As per the prosecution case, informant suspects that these petitioners might have concealed or killed husband of informant. It is further alleged that the accused persons demanded Rs. 2 lacs to search her husband.

4. F.I.R. has been lodged after inordinate delay of about four months without any explanation which itself renders the entire prosecution case doubtful. Prior to institution of the present case, petitioner no.1 had lodged Khaira Police Station Case no. l227/2015 dated 25.10.2015 against the informant and others, in which trial is going on in the Court of Additional Sessions Judge III, Jamui and son of informant is in custody. In order to put pressure to withdraw or compromise that case, this false case has been lodged against these petitioners. Petitioners have got no criminal antecedent.

5. Considering the aforesaid facts of the case, prayer for bail of all the petitioners is allowed. In the event of arrest/surrender within six weeks from today, let these petitioners, mentioned above, be enlarged on bail on furnishing bail bond of Rs.10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of learned Judicial Magistrate 1st class, Jamui in connection with Garhi Police Station Case No. 72 of 2023, subject to the conditions laid down under section 438(2) of the Code of Criminal Procedure. shashi (Prabhat Kumar Singh, J) U T
