This is a case registered under Sections 363 and 366/34 of the Indian Penal Code.

It is submitted by the counsel for the petitioner that the petitioner has falsely been implicated in this case as earlier the informant had implicated the petitioner in respect of same allegations in Birganj P.S. Case No. 69 of 2012 wherein the victim had appeared before the Magistrate and gave statement denying the kidnapping and stated that she was in a relationship with the instant petitioner. In that case the petitioner has already been granted bail. The petitioner is in jail custody since 30.08.2017. In the facts and circumstances of the case, prayer for bail of the petitioner is allowed. Let the petitioner above named be

No.63111 of 2017 (3) dt.19-02-2018 released on bail on his furnishing bonds of Rs 10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of Chief Judicial Magistrate, Purnea in Mirganj P.S. Case No. 117 of 2017 subject to the conditions : (i) That one of the bailors will be a close relative of the Petitioner who will give an affidavit giving genealogy as to how he is related with the Petitioner. The bailor will also undertake to inform the Court if there is any change in the address of the Petitioner.

(ii) That the Petitioner will be well represented on each date and if he fails to do so on two consecutive dates, his bail will be liable to be cancelled.
