This application, for grant of anticipatory bail, arises out of Nabinagar Police Station Case No. 102 of 2011, disclosing offences under Sections 420/ 34 of the Indian Penal Code.
Petitioner is Headmaster of Primary School, Kharia and allegation against him that he swallowed the amount of Rs. 40,000/- which was given to him for renovation of the school building and has not submitted the AC/DC bills for the said amount.
Submission of learned counsel for the petitioner that no such amount was ever given to him and further the school has
Patna High Court Cr.Misc. No.15366 of 2018 (3) dt.03-05-2018 2/3 no building, which he informed to the District Programme Officer, which will appear from Annexure -2 and Annexure 3 is the letter from which it appears that no amount has been given to the petitioner.
Considering the facts and circumstances of the case as well as in view of annexure - 3, let the petitioner, above named, in the event of his arrest or surrender before the Court below within six weeks, be released on bail on furnishing bail bond of Rs. 25,000/- (twenty five thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate -Aurangabad, in connection with Nabinagar Police Station Case No. 102 of 2011, subject to the condition laid down under Section 438 (2) of the Code of Criminal Procedure. I.
One of the bailors of the petitioner shall be a local person having sufficient immovable property within the jurisdiction of the court concerned.

The petitioners shall cooperate in the investigation and make himself available as and when required by the police and on the event on failure of his part to appear before the police on two consecutive dates, the
Patna High Court Cr.Misc. No.15366 of 2018 (3) dt.03-05-2018 3/3 prosecution will be free to move for cancellation of his bail bonds.
