2. The petitioner is apprehending his arrest in connection with Jagdishpur P.S. Case No. 53 of 2025 registered for the offence punishable under Section 305 of the Bharatiya Nyaya Sanhita, lodged on 08.02.2025 by the informant Gopal Kumar.

3. As per the prosecution story, the informant alleged that while he was away for Kumbh Mela to take Kumbh bath, theft took place and case of Rs.6,20,000/- beside gold ornaments were taken away. This led to the F.I.R.

4. The investigation of the Police took them to Sumit Kumar who named the present petitioner.

5. Learned counsel for the petitioner submits that he is a young boy, having no role to play and only on the basis of

6. Learned APP opposes the prayer submitting that the cash of Rs.6,20,000/- beside gold ornaments were taken away and the role of this petitioner has come during the course of investigation.

7. Considering the submissions of the parties as also the materials on record, no case of anticipatory bail is made out, which is accordingly rejected.

8. However, if the petitioner surrenders within a period of four weeks, files bail application, the court concerned shall consider the matter and dispose it of preferably on the same day.
