The petitioner is in custody in connection with Charpokhari P.S.Case No.225 of 2017 registered for an offence under the Arms Act.

It has been submitted that the name of this petitioner was disclosed by one Jairam Yadav. The police party seized one loaded fire arm from the possession of said Jairam Yadav and on interrogation, he disclosed that he was going to hand over the said fire arm to this petitioner. The police conducted raid and seized one live cartridge and 31 empty cartridges from the house. It has further been submitted that the recovery was allegedly made from the house which in possession of joint family. The petitioner is in custody since 25.09.2017 and except the disclosure of name of this

Patna High Court Cr.Misc. No.63267 of 2017 (2) dt.11-01-2018 2/2 petitioner by another co-accused, there is nothing against him. Learned APP opposed the submission.

Considering the clean antecedent of this petitioner facts and circumstances of the case, prayer for bail is allowed. Let the above named petitioner be released on bail o n furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of ACJM-IV, Bhojpur at Ara in connection with Charpokhari P.S.Case No.225 of 2017.
