JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 04-11-2019 Heard learned counsel appearing for the petitioner as well as learned Additional Public Prosecutor for the State. Petitioner seeks bail in a case registered for the offences punishable under Sections 413 and 414 of the Indian Penal Code.

The name of petitioner came in this case in confessional statement of co-accused Guddu Kumar, who was arrested on the spot but, admittedly, neither petitioner was caught on the spot nor anything was recovered from his conscious possession. Moreover, some co-accused persons, from whose possession stolen motorcycles are said to have been recovered, have already been granted privilege of bail by different co-ordinate Benches of this Court.
