2. Learned counsel for the petitioner, submitted that the grievance of the petitioner is restricted only to the payment of interest amount @12% over the delayed payment of earned leave, gratuity and monthly pension benefit of the petitioner's father, which has only been paid to him on account of intervention of the Hon'ble Court in June, 2020, irrespective of the fact that the father of the petitioner died on 26.10.2010 itself. He further submitted that in identical matter, this Court has directed the respondent/Bank to ensure payment of statutory interest over the delayed payment but so far the present case is concerned, discrimination has been caused and the petitioner has not been allowed interest over the delayed payment, compelling him to approach before this Court. He

Patna High Court CWJC No.16273 of 2023(2) dt.16-01-2024 2/2 further submitted at the Bar that though several representations have been filed but till date the same has not been disposed of by the respondent/Bank.

3. At this juncture, learned counsel for the respondent/Bank, submitted that from the record, it is evident that no such representation has been filed along with the present writ petition.

4. Considering the submissions advanced on behalf of the parties, this Court deems it apt and proper to dispose of the writ petition with a liberty to the petitioner to file an appropriate representation along with the order of this Court before the respondent no.1, the Chairman, Uttar Bihar Gramin Bank, Kalambagh Raod, Muzaffarpur, preferably within a period of four weeks from today.

5. If such a representation is filed, the respondent no.2, shall consider and disposed of the same in the light of the order of this Court dated 20.08.2018 passed in C.W.J.C. No. 9311 of 2015, preferably within a further period of eight weeks. (Harish Kumar, J) rohit/- U
