Petitioner, already in custody, seeks bail in connection with Ahiyapur P.S. Case No.425 of 2015, registered under Sections 395/397 of the Indian Penal Code.

Learned counsel for the petitioner submits that FIR is against unknown, neither there is any recovery from possession of the petitioner nor he was put on TIP, except disclosure of name of the petitioner by one Satrughan Ram in his confessional statement, there is no other material, other co-accused from whose possession recovery was made have been granted bail by coordinate Benches of this Court by order dated 10.11.2015, passed in Cr. Misc. No.50181 of 2015, order dated 20.08.2015, passed in Cr. Misc. No.34258 of 2015 and order dated

Patna High Court Cr.Misc. No.62855 of 2017(5) dt.21-02-2018 2/2 28.08.2015, passed in Cr. Misc. No.38241 of 2015, the investigation is complete and the petitioner is in custody since 30.08.2016.

Having considered the said facts and circumstances, petitioner Jitan Ram @ Shiv Chandra Ram is directed to be released on bail on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Judicial Magistrate, 1st Class, Muzaffarpur in connection with Ahiyapur P.S. Case No.425 of 2015, with condition that the petitioner shall remain present before the trial court on each and every date and if he absents himself on two consecutive dates without any reasonable ground, his bail bond shall liable to be cancelled.
