2. Petitioner apprehends arrest in a case registered for the offence punishable under sections 406, 407, 408 , 409 and 420 of I . P. C .

3. As per the prosecution case, it is alleged that this petitioner, along with other co-accused persons, withdrew and misappropriated the government money from the Pay Jal Nischay Yojana without completing the work .

4. Learned counsel for the petitioner submits that the petitioner is innocent and has falsely been implicated in this case and the work in question has already been completed. There is no evidence against this petitioner that he misappropriated the alleged amount. Petitioner claims clean

5. However, learned counsel for the State opposes the prayer for bail and submits that there is specific allegation against the petitioner that at the relevant time he was Panchayat secretary who allegedly withdrew and misappropriated the government money of the Pay Jal Nischay Yojana without completing the work .

6. Considering the nature of accusation and gravity of offence , prayer for pre-arrest bail of the petitioner is rejected. (Prabhat Kumar Singh, J) Koushik/- U T
