JUSTICE VINOD KUMAR SINHA ORAL ORDER 21-06-2018 Petitioner apprehends his arrest in connection with Mansi P.S.Case No. 295 of 2017 registered for the offences punishable under Sections 307, 385, 504, 506, 34 of the Indian Penal Code and Section 27 of the Arms Act.
Allegation against the petitioner is that he has fired upon the informant but the same was hit Bhupesh Kumar and there is also allegation of demanding extortion.
Submission of learned counsel for the petitioner is that there is case and counter case between the parties and during investigation material has come that story of demanding extortion is false and there was altercation between the parties in course of that the occurrence took place.
Heard learned APP also.
Patna High Court Cr.Misc. No.22055 of 2018 (3) dt.21-06-2018 2/2 Having heard both sides and in the facts and circumstances, I am not inclined to grant privilege of anticipatory bail to the petitioner. Petitioner to surrender and make prayer for regular bail, which shall be considered on its own merit, without being prejudiced by this order.
