JUSTICE VINOD KUMAR SINHA ORAL ORDER 21-06-2018 Petitioner apprehends his arrest in connection with Narhat P.S.Case No. 66 of 2017 registered for the offences punishable under Section 376 of the Indian Penal Code. Allegation against the petitioner is that he entered inside the house of the informant and committed rape upon her. Submission of learned counsel for the petitioner is that the whole prosecution story appears to be improbable as other family members of the informant were present there and in such a situation it is not probable that rape can be committed. Further submission is that there is delay of two days in lodging FIR. Heard learned APP also.
Having heard both sides and in the facts and circumstances, I am not inclined to grant privilege of anticipatory
