The petitioners apprehend their arrest in connection with Sono (Charkapather) P.S. Case No.303 of 2018 registered under Section 364 read with Section 34 of the Indian Penal Code.

The accusation is that Gushal Manjhi (petitioner no.1) and Madan Manjhi had lodged Sono (Charkapather) P.S. Case No.262 of 2017 against Ashok Manjhi and Krishna Manjhi, the son and the husband of the informant Manju Devi, respectively, in respect of the kidnapping of a girl on 30.10.2017. Thereafter, the informant along with her family members were driven out

Patna High Court CR. MISC. No.74334 of 2019(2) dt.06-02-2020 2/3 from the house and they started to live in village-Bojhaiet at the house of her daughter. In the morning of 20.10.2018, Krishna Manjhi, the husband of the informant, moved from there, saying that he is going to village-Bogaiya but he did not return. On search, no trace of the husband of the informant was found. The informant raised suspicion about kidnapping and committing the murder of her husband by these petitioners and Madan Manjhi. Learned counsel for the petitioners submits that it would appear from the F.I.R. that after lodging of the case of kidnapping of a girl by Gushal Manjhi (petitioner no.

1) and Madan Manjhi against the son and husband of the informant, the informant and her other family members started to live at the house of her daughter but only to put undue pressure upon the petitioners and Madan Manjhi, the informant has lodged the present case, after fifteen days of the occurrence, so that the petitioners and Madan Manjhi could not pursue in the aforesaid case of kidnapping of a girl, which was lodged against the son and the husband of the informant.

Having considered the facts and the circumstances of the case, let the petitioners, above named, in the event of their arrest or surrender by them within six weeks from today, be enlarged on bail on their furnishing bail bond of Rs.10,000/-

Patna High Court CR. MISC. No.74334 of 2019(2) dt.06-02-2020 3/3 (Rupees Ten Thousand) each with two sureties of the like amount each to the satisfaction of the Additional Chief Judicial Magistrate-I, Jamui, in connection with Sono (Charkapather) P.S. Case No.303 of 2018, subject to the conditions laid down under Section 438(2) Cr.P.C.
