The petitioner has approached this Court on the very issuance of the notice by the Circle Officer, Tetiya Bamber, Munger, in exercise of power under Section 3 of the Bihar Public Land Encroachment Act, 1956.
In our opinion, this writ application is pre-mature and the petitioner would be well advised to respond to the impugned notice by putting-forth his claim with supporting evidence, which would be decided by the Circle Officer, Tetiya Bamber, Munger, in accordance with law.
With the above observation, the application is disposed of.
