Petitioners apprehend their arrest in connection with Complaint Case No. 217 of 2017 registered for the offences punishable under Sections 341, 323 and 354B of the Indian Penal Code.

Complaint case is that scuffle took place between the parties and petitioners have assaulted the complainant and tried to humiliate her.

Submission of learned counsel for the petitioners is that petitioners have filed case against the complainant prior to the present case and there is allegation of assault and no specific

Patna High Court Cr.Misc. No.26541 of 2018 (3) dt.20-07-2018 2/2 allegation has been attributed against them.

In spite of valid service of notice opposite party No.2 has not appeared.

Having heard both sides and in the facts and circumstances, let the petitioners, named above, in the event of their arrest or surrender, be released on bail on furnishing bail bonds of Rs.25,000/- (Rupees twenty five thousand) each with two sureties of the like amount each to the satisfaction of Sri N.P.Singh, Sub-Divisional Judicial Magistrate, Saharsa, in connection with Complaint Case No. 217 of 2017, subject to the conditions as laid down under Section 438(2) Cr.P.C. and further condition is that one of the bailors shall be a local person having sufficient immoveable properties within the jurisdiction of court concerned.
