The petitioner apprehends his arrest in a case registered for the offences punishable under Sections 419 and 420 of the Indian Penal Code and Section 15(2) of the Indian Medical Act, 1956.
Learned Senior Counsel for the petitioner submits that the petitioner has antecedent of one case in which he has been granted the privilege of anticipatory bail and the informant alleges that on orders of Ex-Pradesh Deputy Chairman JD(U), a raiding team was constituted which submitted a report that petitioner is illegally running Suman Arogya Clinic. Learned Senior Counsel for the petitioner submits that

No.4987 of 2023(3) dt.04-07-2023 2/3 the petitioner has been falsely implicated in the present case, it is next submitted that the move was purely political in order to falsely implicate the petitioner in the present case, as petitioner was not willing to cow down before the Ex-Pradesh Deputy Chairman of JD(U) for political reasons, it is next submitted that petitioner in the year 2014 had passed a final examination of Bachelor of Ayurvedic Medicine and Surgery from Baba Saheb Bhimrao Ambedkar Bihar University, Muzaffarpur and thus is authorized to practice as a doctor (Ayurvedacharya), it is next submitted that from perusal of Annexure-2, it would manifest that the certificate was also issued by the University from where he had passed his Bachelor of Ayurvedic Medicine and Surgery, thereafter, petitioner on 22.08.2016 was registered with State Council of Ayurvedic and Unani Medicine, Bihar and started practicing as Vaidhya in a room of his residential house in the name and style of Suman Arogya Clinic.
Learned Senior Counsel for the petitioner submits that petitioner is not running a hospital rather is a practicing Vaidhya but for reasons political, the present false case came to be instituted.
Learned A.P.P. for the State opposes the prayer for anticipatory bail of the petitioner.

No.4987 of 2023(3) dt.04-07-2023 3/3 Considering the submissions made by the learned counsel for the petitioner, the petitioner above-named, in the event of his arrest or surrender before the learned trial court within a period of six weeks from today, be released on anticipatory bail on furnishing bail bonds of Rs. 5,000/- (Rupees Five Thousand) with two sureties of the like amount each to the satisfaction of the learned trial court where the case is pending/successor court in connection with Guraru P.S. Case No. 65 of 2022 subject to the conditions as laid down under Section 438 (2) of the Cr.P.C.
